A study on The Corporate Practice of Medicine Doctrine

Abstract

|
Today¢¥s health care industry is dominated by health maintenance organizations(HMOs) and other large corporations which operates in the era of "managed care". Along with the proliferation of profit-seeking health care organization, statutory exceptions also signal an acceptance of the risks of commercial exploitation and divided loyalty and narrow the reach of the corporate practice ban, thus diminishing the force of these public policy bases for the continued existence of the corporate practice of medicine doctrine. Additionally current application of the corporate practice ban extend the doctrine beyond its intended scope and impede necessary continued movement towards efficiency in the health care industry. Thus, the corporate practice of medicine doctrine impedes the operation of interstate health care corporations, which would otherwise be engines of efficiency by centralizing administrative functions and leveraging their size to minimize costs as do managed care organizations.
